How we use your information We use your information only to:\ncreate, verify, secure and administer your account; receive your navigation requests and return directions to you by SMS; send you service and account communications, including verification codes and pre-deletion or discontinuation notices; maintain, troubleshoot and improve the Service; and protect the Service against misuse, fraud, abuse and security threats, and comply with applicable law. 6. How we share your information \u0026ndash; service providers We do not sell your personal information, and we do not share it with any third party for that party\u0026rsquo;s own marketing, advertising, tracking or profiling.\nWe share information only with the third-party service providers necessary to operate the Service, and only to the limited extent described below. Each provider processes data under its own privacy policy, over which we have no control.\nTextbelt (SMS delivery): receives your phone number and the content of your SMS messages in order to send and receive texts. https://textbelt.com/privacy\nMailjet (email delivery): receives your email address in order to send account creation and password verification emails. https://www.mailjet.com/legal/privacy-policy\nMapbox (routing): receives the start and end addresses in your requests in order to generate directions. https://www.mapbox.com/legal/privacy\nOpenRouteService (routing): receives the start and end addresses in your requests in order to generate directions. https://ask.openrouteservice.org/privacy\nRender (hosting): hosts the Service and therefore processes all application data, including data held in its automated backups and server logs. https://render.com/privacy\nCloudflare (DNS): processes IP-address information in providing DNS and security for our domains. https://www.cloudflare.com/privacypolicy\nWe may also disclose information where required to do so by law (see Section 8.6). Some of these providers may process limited data outside the United States in accordance with their own policies.\nWe may add, remove, or change service providers as the Service develops. Retention by third-party providers Even though we delete data from our own systems as described in Section 8, the providers identified in Section 6 retain data independently, on their own schedules and outside our control. In particular, Textbelt retains SMS data (including your phone number and message content), Mailjet retains email delivery data (including your email address and email content), Render retains automated database backups and server logs (which may contain phone numbers, IP addresses and request content), and Cloudflare retains IP-address information, in each case for the period and on the terms set out in that provider's own privacy policy.\nThe applicable retention periods are determined by each provider and may change. We therefore cannot guarantee deletion of data held within these third-party systems before the expiry of the relevant provider's retention period. Data retention and deletion We do not keep your data longer than necessary to provide the Service, and we do not maintain our own separate archive of your data beyond the infrastructure backups described above.\n8.1 Navigation request data. Navigation request data is automatically and permanently deleted on a continuous rolling basis once it is more than seven (7) days old. This deletion occurs automatically and without separate notice to you. Once deleted, such data is not retained by, or accessible to, you or us, and cannot be recovered.\n8.2 Inactive accounts. If you do not log in or make a navigation request for ten (10) days, your account is marked inactive. We will send an email to the address on your account at least twenty-four (24) hours before deletion. You can prevent deletion by logging in or making a request during that period. If you do not, your account and all associated data are permanently deleted.\n8.3 Deletion at your request. You can permanently delete your account and all associated data at any time from within the web application. Deletion takes effect immediately on our systems.\n8.4 Deletion by us. We may suspend or delete your account and associated data where necessary to enforce our Terms of Service, including in cases of misuse, spam, abuse or unlawful use. Our rights in this regard are set out in the Terms of Service.\n8.5 What \u0026ldquo;permanent deletion\u0026rdquo; means. When we delete your data, we remove it from our active systems promptly and permanently, and we are not able to recover or restore it. As explained in Section 7, however, copies may persist for limited periods within third-party systems outside our control, including service providers\u0026rsquo; backups, logs, and records, until they expire under each provider\u0026rsquo;s own retention practices.\n8.6 Legal requirements. We may retain or disclose information to the extent we are required to do so by applicable law, regulation, legal process, or an enforceable governmental or court order. In such circumstances, deletion of the affected data may be delayed only to the extent, and for the period, necessary to satisfy that obligation.\n8.7 Discontinuation of the Service. The Service is in open-ended beta and may be discontinued. By registering for and using the Service, you expressly consent to receive SMS Messages from the Operator at the mobile telephone number associated with your Account, including SMS Messages comprising Navigation Output and SMS Messages relating to the operation, security, and administration of the Service.\n4.2 The SMS Messages you receive are sent in response to, and in connection with, your use of the Service. The Operator does not transmit marketing or promotional SMS Messages.\n4.3 Message frequency depends on your use of the Service. Message and data rates may be charged by your mobile carrier in accordance with your mobile service plan. The Operator is not responsible for any such charges.\n4.4 You may opt out of receiving SMS Messages at any time by replying \u0026ldquo;STOP\u0026rdquo; to any SMS Message received from the Service. Following such opt-out, the Operator will cease transmitting SMS Messages to the relevant mobile telephone number, and the Service will no longer function for that number. You may reply \u0026ldquo;HELP\u0026rdquo; to obtain assistance.\n4.5 For the avoidance of doubt, opting out of SMS Messages renders the Service inoperable, as the Service can be delivered only by SMS. Opting out does not, of itself, delete your Account; Account deletion is governed by Sections 11 and 12.\n4.6 You represent and warrant that you are the subscriber or customary user of the mobile telephone number provided at registration, and that you are authorized to consent to receive SMS Messages at that number. Account Registration 5.1 To use the Service, you must register an Account by providing a valid email address and a valid mobile telephone number. You agree that the information you provide is accurate, current, and complete.\n5.2 You are responsible for all activity conducted through your Account and for maintaining the confidentiality of any credentials associated with your Account. You must notify the Operator promptly of any unauthorized use of your Account.\n5.3 You must not register an Account on behalf of any other person, or provide a mobile telephone number or email address that you are not authorized to use.\n6. Acceptable Use 6.1 You agree to use the Service only for lawful purposes and in accordance with these Terms.\n6.2 You must not:\n(a) use the Service in any manner that violates any applicable law or regulation;\n(b) use the Service to transmit any unlawful, harassing, or abusive content;\n(c) interfere with, disrupt, or impose an unreasonable burden on the Service or the infrastructure on which it operates, including by transmitting automated, bulk, or high-volume Navigation Requests;\n(d) attempt to gain unauthorized access to the Service, to any Account other than your own, or to any system or network connected to the Service;\n(e) reverse engineer, or otherwise attempt to derive the source code or underlying structure of the Service, except to the extent such restriction is prohibited by applicable law;\n(f) use the Service to develop, train, or populate any competing product or dataset, or to extract, scrape, or systematically harvest Navigation Output; or\n(g) use the Service in any safety-critical context, or in any circumstances in which the failure or inaccuracy of the Service could result in death, personal injury, or property damage.\n6.3 The Operator may suspend or terminate your access to the Service, in accordance with Section 12, where it determines that you have breached this Section 6.\n7. Privacy 7.1 The Operator\u0026rsquo;s collection, use, retention, and disclosure of personal data in connection with the Service are governed by the Privacy Policy, which forms part of these Terms.\n7.2 You acknowledge that Navigation Request data is retained for a limited period and is automatically deleted thereafter, and that the data-access, download, and deletion controls available to you are constrained to that retention window, in each case as described in the Privacy Policy.\n8. Beta Status, Service Availability, and Modifications 8.1 The Service is provided on an \u0026ldquo;as available\u0026rdquo; basis during an open-ended beta period. The Operator does not warrant that the Service will be available, uninterrupted, timely, secure, or error-free, and provides no service-level commitment or uptime guarantee.\n8.2 The Operator may, at any time and without prior notice or liability, modify, suspend, or discontinue the Service or any part of it, including by altering its features, functionality, or third-party dependencies.\n8.3 The Service depends on third-party providers for message delivery, mapping, and routing. The Operator does not warrant the continued availability of any such provider, and the suspension or discontinuation of any such provider may result in the interruption or discontinuation of the Service.\n8.4 The Operator is under no obligation to provide support, maintenance, updates, or error corrections in respect of the Service.\n9. Navigation Disclaimer 9.1 Navigation Output is provided for general informational purposes only. You must not rely on Navigation Output as your sole or primary source of navigation, and you must not rely on Navigation Output for any safety-critical decision.\n9.2 Navigation Output may be inaccurate, incomplete, or out of date. It may not account for road closures, construction, traffic conditions, weather, one-way restrictions, vehicle or load restrictions, or other conditions affecting a route. The Operator does not verify Navigation Output and does not warrant its accuracy, completeness, or suitability for any purpose.\n9.3 You remain solely responsible for your conduct while traveling.\n9.4 For the avoidance of doubt, the Operator accepts no responsibility for any route taken, any delay, or any consequence arising from your reliance on Navigation Output.\n10. Intellectual Property 10.1 As between you and the Operator, the Operator owns all right, title, and interest in and to the Service, including its software, design, and presentation, together with all associated intellectual property rights. Subject to your compliance with these Terms, the Operator grants you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use during the term of your Account.\n10.2 Navigation Output is derived from third-party mapping and routing data that is licensed to the Operator by its providers and remains subject to the terms imposed by those providers. The Operator makes no representation or warranty as to your rights in respect of such third-party data, and you must not use Navigation Output in any manner inconsistent with the applicable third-party terms.\n10.3 Nothing in these Terms transfers to you any ownership of the Service or of any third-party data, save for the limited licence expressly granted in Section 10.1.\n11. Account Inactivity and Data Deletion 11.1 An Account that remains inactive for a continuous period of ten (10) days will be marked for deletion. The Operator will notify the User by email that the Account, together with the associated Account data, will be deleted within twenty-four (24) hours of such notice, unless, within that period, the User either logs in to the Account or submits a Navigation Request from the mobile telephone number associated with the Account. Where the User takes neither step within that period, the Account and the associated Account data will be deleted in accordance with the Privacy Policy.\n11.2 Deletion of an Account under Section 11.1 is permanent. Once an Account and its associated data have been deleted, they cannot be recovered, and you will be required to register a new Account to resume use of the Service; however, a new Account cannot be registered using the same email address for a period of at least forty-eight (48) hours following deletion.\n11.3 Certain data may be retained by the Operator\u0026rsquo;s third-party hosting and infrastructure providers, for limited periods and outside the Operator\u0026rsquo;s direct control, as described in the Privacy Policy. To the maximum extent permitted by applicable law, the Operator shall not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with these Terms or your use of, or inability to use, the Service, whether based in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not the Operator has been advised of the possibility of such damages.\n14.2 To the maximum extent permitted by applicable law, the aggregate liability of the Operator arising out of or in connection with these Terms or your use of the Service shall not exceed the greater of (a) the total amount, if any, paid by you to the Operator for the Service in the twelve (12) months preceding the event giving rise to the claim, and (b) Fifty United States dollars (US $50). Indemnification 15.1 To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless the Operator from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with:\n(a) your use or misuse of the Service;\n(b) your breach of these Terms;\n(c) your violation of any applicable law or of the rights of any third party; or\n(d) any content or information you transmit through the Service.\n16. Governing Law and Dispute Resolution 16.1 These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-laws principles, and by the federal laws of the United States to the extent applicable.\n16.2 Before commencing any formal proceeding, the parties shall first attempt in good faith to resolve any dispute informally by written notice to the other party describing the dispute and the relief sought.\n16.3 Subject to Section 16.2, the parties submit to the exclusive jurisdiction of the state and federal courts located in New York in respect of any dispute arising out of or in connection with these Terms.\n17. Changes to These Terms 17.1 The Operator may amend these Terms from time to time. Where the Operator does so, it will update the \u0026ldquo;Last Updated\u0026rdquo; date set out above and, where the changes are material, will take reasonable steps to notify Users.\n17.2 Your continued use of the Service following the effective date of any amendment constitutes your acceptance of the amended Terms. If you do not agree to the amended Terms, you must cease using the Service and may delete your Account.\n18. General 18.1 Entire agreement. These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and the Operator in respect of the Service, and supersede all prior agreements and understandings.\n18.2 Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or, if it cannot be so modified, severed, and the remaining provisions shall continue in full force and effect.\n18.3 No waiver. No failure or delay by the Operator in exercising any right under these Terms constitutes a waiver of that right, and no single or partial exercise of any right precludes any further exercise of it.\n18.4 Assignment. You may not assign or transfer your rights or obligations under these Terms without the Operator\u0026rsquo;s prior written consent. The Operator may assign or transfer its rights and obligations under these Terms, including in connection with a transfer of the Service.\n18.5 Force majeure. The Operator shall not be liable for any failure or delay in performance arising from any cause beyond its reasonable control, including the failure or unavailability of any third-party provider, mobile carrier, or network.\n18.6 No agency. Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship between you and the Operator.\n18.7 Notices.
